SALARY RANGE: $165,000 – $190,000

LOCATION: 2 Broadway

HOURS OF WORK: 9:00 am - 5:30 pm (7 1/2 hours/day)

This position is eligible for telework which is currently one day per week. New hires are eligible to apply 30 days after their effective date of hire.

SUMMARY:

The position will represent MTA in connection with real estate, contracting, transactional and commercial related legal matters so as to protect and preserve MTA’s legal interests and help monetize its real property interests, by assisting with and overseeing complex joint development and transit-oriented transactions, capital projects and transit improvements. The position will work collaboratively with the MTA real estate transit-oriented development and planning department within MTA C&D as well as with the MTA real estate department and other MTA attorneys to efficiently and cost-effectively facilitate the use, acquisition and disposition of real property interests and other assets on development projects, public-private partnerships with a transit improvement components, capital projects and securing subway entrance enhancements and accessibility initiatives.

RESPONSIBILITIES:

  • Review, analyze, draft and negotiate a broad variety of complex real estate related contracts and documents, including easements, leases, land disposition agreements, licenses and permits.

  • Provide legal and business advice with regard to complex enterprise-wide contract negotiations for real estate related matters.

  • Assist with the administration of the Real Estate Development legal group, including (i) management and control of and responsibility for drafting/updating of real estate boilerplate form documentation and a real estate form library, with a heavy emphasis on leases, licenses, easements and permits and (ii) implementation of legal training program.

  • As time permits, provide legal support in other practice areas in support of MTA’s mission, including proposed and enacted legislation, contractor responsibility, corporate issues and state and federal rules and regulations.

  • Provide legal support to the MTA Real Estate Transit Oriented Development and MTA Construction & Development teams.

  • Advise MTA Real Estate Transit-Oriented Development team and business unit clients regarding legal and business risks.

  • Select, develop and motivate personnel within the department. Provide career development for subordinates. Provide prompt and effective coaching and counseling. Responsible for discipline/termination of employees when necessary. Review performance of staff. Create a professional environment that respects individual differences and enables all employees to develop and contribute to their full potential.

  • Other duties as assigned.

    PREFERRED:

  • Familiarity with the MTA’s policies and procedures

    EDUCATION AND EXPERIENCE:

  • Law Degree. Must possess a NYS license to practice law.

  • Minimum eight (8) years’ experience of relevant legal experience at a large law firm or supporting a large governmental or private section required

  • Minimum six (6) years’ experience on sophisticated real estate development transactions.

  • Pertinent experience drafting and negotiating contracts under NY law.

  • Working knowledge of New York Real Property Law, New Real Property Actions and Proceedings Law, New York Lien Law, New York Public Authorities Law and pertinent provisions of New York General Obligations Law.
